Withdrawal Policy & Withdrawal Form

Consumers have a right of withdrawal under the following provisions, whereby a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their commercial or self-employed professional activities.

A. Withdrawal Policy

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without providing any reasons.

The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, takes possession of the last item.

To exercise your right of withdrawal, you must inform us (MPI-VV UG,Weidestraße 43, 22083 Hamburg, Deutschland, Tel.: 01728616596, E-Mail: info@canopy-systems.de) of your decision to withdraw from this contract through a clear statement (e.g., a letter sent by post or email). You may use the attached model withdrawal form, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication regarding the exercise of the right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we will refund you all payments received from you, including delivery costs (except for any additional costs arising from your choice of a delivery method other than the least expensive standard delivery offered by us), without delay and at the latest within fourteen days from the day we received your notice of withdrawal from this contract. We will use the same payment method you used for the original transaction for this refund, unless you have explicitly agreed otherwise; in any case, you will not incur any fees due to this refund. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return the goods promptly and in any event no later than fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period has expired.

You bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods if this loss in value is due to handling them in a way that is not necessary to check their nature, characteristics, and functioning.

Exclusion or Early Expiration of the Right of Withdrawal

The right of withdrawal does not apply to contracts for the delivery of goods that are not pre-made and for which the consumer's individual choice or specification is decisive for their production or which are clearly tailored to the personal needs of the consumer.

Linked/Financed Transactions

If you finance this contract through a loan and later withdraw, you are also no longer bound by the loan agreement, provided that both contracts form an economic unit. This is particularly assumed when we are simultaneously your lender or if your lender has used our assistance regarding the financing. If the loan has already been credited to us at the time of withdrawal or upon return of the goods, your lender assumes our rights and obligations regarding the legal consequences of the withdrawal or return. This does not apply if the current contract involves the acquisition of financial instruments (e.g., securities, currencies, or derivatives). If you want to avoid a contractual commitment as much as possible, exercise your right of withdrawal and also withdraw from the loan agreement if you also have a right of withdrawal for that.

General Notes

  1. Please avoid damaging or soiling the goods. Please return the goods in their original packaging with all accessories and packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure sufficient protection against transport damage with suitable packaging.
  2. Please do not return the goods to us freight collect.
  3. Please note that the above points 1-2 are not a prerequisite for the effective exercise of the right of withdrawal.
